Significant changes to Maryland’s Stormwater General Permit regulations require action now for industrial and construction activity. In addition, a major update to the MDE Stormwater Design Manual will have wide-ranging impacts.

There are significant changes to Maryland’s Stormwater General Permit regulations this year.

20-SW — Industrial Activities

  • Permit regulations were updated in 2023 to authorize the discharge of stormwater associated with industrial activity.
  • New requirements include changes to benchmark thresholds, Environmental Justice requirements, and PCB sources.

20-CP — Construction Activity

  • Effective as of 01 April 2023, permit updates are required for all sites disturbing greater than 1 acre of disturbance.
  • All previous permits under 14-GP have until 30 September 2023 to obtain coverage or will be terminated.
  • 20-CP is generally similar to 14-GP but includes new requirements for some sites including enhanced inspection and SWPPP.

Maryland A-StoRM

  • MDE released their Proposed Stormwater Management Regulatory Requirements for New Development and Redevelopment in Maryland on 26 July 2023, which will change stormwater management requirements for projects in Maryland.
  • Updates are part of Maryland’s overall plan to mitigate urban flooding and improve stormwater flood management.
